Még azelőtt elfogták őket, hogy kiadták volna ellenük az európai elfogatóparancsot. They were apprehended before the European Arrest Warrant was published.

Lőkösháza vasúti határátkelőhelyen a Bukarestbe tartó Ister nemzetközi gyorsvonat utasai közül 2015. november 14-én két együtt utazó férfi nem tudta igazolni magyarországi tartózkodásának jogszerűségét, és állampolgárságát a békési rendőröknek. Egyiküknél volt ugyan egy angol vezetői engedély, a másiknál azonban még az sem – mindössze egy Koránt adott át a rendőröknek. Előállították őket.

A határrendészeti kirendeltségen kiderült, az angol jogosítvány valódi, tényleg a 44 éves K. Simon Jonathan brit állampolgáré. Útitársát bemondott személyi adatai alapján a brit konzuli ügyelet nem tudta angol állampolgárként azonosítani. Mindketten kiutasítást előkészítő őrizetbe kerültek. Az idegenrendészeti eljárás során az addig azonosítatlan férfi közölte valódi nevét: B. Trevor, szintén brit állampolgár, és 40 éves.

Ügyükben 2015. november 17-én 16 óra körül történt változás: a schengeni körözési rendszerben megjelent mindkettőjük európai elfogatóparancsa. A két férfi nem jelezte az angol hatóságoknak, hogy elhagyják Angliát, pedig erre bírósági ítélet kötelezte őket. Korábban ugyanis terrorcselekmény-finanszírozása miatt egy alkalommal másfél évet, egy másik alkalommal három és fél évet töltöttek börtönben, 2009-ben szabadultak, és az ítélet szerint a szabadulásukat követő tíz évig csak az angol hatóságok engedélyével hagyhatták volna el Angliát.

 

 

Out of passengers travelling through Lőkösháza railway border crossing point to Bucharest on the international train “Ister”, two males travelling together on 14 November 2015 could not prove the lawfulness of their residence in Hungary and their nationality to the police officers of Békés County. Although one of them carried a driver’s licence of the United Kingdom, the other one did not carry any documents – he could only hand over a Quran to the police officers. They both were arraigned.

At the border policing station it turned out that the British drivers licence is genuine and indeed belongs to K. Simon Jonathan, British citizen, aged 44. His fellow passenger could not be identified by the British consular duty desk based on the personal data communicated. They both were taken into pre-expulsion custody. In the aliens policing procedure the so far unidentified man indicated that his real name being B. Trevor, he is a British citizen, aged 40.

Their case changed at 16.00 on 17 November 2015 when a European Arrest Warrant relating to both of them appeared in the Schengen Information System. The two men did not inform the British authorities to leave Britain, although a court’s decision ordered them to do so. They spent one and a half year and on other occasion, three and a half years in detention for financing a terrorist act, were both released in 2009 and according to the decision, they could have only leave Britain with the consent of the British authorities for another ten years.
